Gun-liability insurance ? The Reality-Based Community

I?m not a fan of mandatory liability insurance for gun owners; Megan McArdle picks some good holes in the proposal, without even mentioning the big problem about how to attribute liability when the firearm used in an assault or homicide is never recovered by law enforcement. But even a flawed concept ought to be considered in its most nearly plausible form.

For gun-liability insurance, it seems to me the most plausible form would be strict liability on the manufacturer (or importer) for any damage to third parties done with the gun, and a requirement that the liable party either carry insurance or post a bond (to avoid the ?judgement-proofness? problem.) Damage from unrecovered weapons could be allocated on the market-share principle.

That system would give the gun industry a strong incentive to be careful about not selling to people who might misuse the weapon or re-transfer it to someone who would. In effect, such a law would force the gun industry to act as a regulatory authority.

Now go back to Megan?s piece to read about all the issues that would raise. And then think about how hard it would be for anyone living in a poor African-American neighborhood to buy a gun.

Senate renews warrantless surveillance act

The U.S. Senate Friday voted?overwhelmingly in favor of keeping a?George W. Bush-era surveillance law that will allow continued warrantless surveillance of Americans for the next five years.

The Senate's 73-23 vote on the Foreign Intelligence Surveillance Act (FISA) is an extension of the warrantless wiretapping law that grants legal immunity to telecommunications providers in order to continue to assist intelligence agencies with monitoring communications.

In addition to phone calls, text messages and emails may also be obtained by investigators for counterterrorism purposes, an easy assertion for law enforcement to make, Gizmodo reports.

The Electronic Frontier Foundation, an Internet rights advocacy organization, claimed in a statement that the act "allows the government to get secret FISA court orders???orders that do not require probable cause like regular warrants???for any emails or phone calls going to and from overseas. The communications only have to deal with "foreign intelligence information," a broad term that can mean virtually anything. And one secret FISA order can be issued against groups or categories of people???potentially affecting hundreds of thousands of Americans at once."

"Incredibly, the Senate rejected all the proposed amendments that would have brought a modicum of transparency and oversight to the government's activities," the EFF said?Friday?after the vote.

The bill is now headed for President Obama's desk where he is expected to sign it. Although an identical bill elicited contentious debate in 2008, a different political climate made passage much easier now.

"This is the last opportunity for the next five years for the Congress to exercise a modest measure of real oversight over this intelligence surveillance law," Sen. Ron Wyden,?D-Oregon, told the press before the vote. "It is not real oversight when the United States Congress cannot get a yes or no answer to the question of whether an estimate currently exists as to whether law abiding Americans have had their phone calls and emails swept up under the FISA law."

Wyden had introduced an amendment to the bill that would have forced the National Security Agency?to disclose how many Americans had been affected by FISA. Since 2009 the agency has refused to share that information on the basis that it would violate the privacy of those affected.?

Book Review: APE ? Author, Publisher ... - Akamai Marketing

It?s a natural step for bloggers to consider publishing; self publishing books is easier than ever before. And yet. That doesn?t mean the process is easy. If only..there were a single resource written by people who have been through the process. People who could provide you the details of how to self-publish. And that is why I jumped at the chance to get my hands on an early review copy of APE-Author, Publisher, Entrepreneur by Guy Kawasaki and Shawn Welch. As a young writer, actually publishing a book seemed like a pipe-dream, particularly given the fact that I also always dreamed of eating and having shelter. But given my dream to one day be published, I agreed to write a review of my experience of the book in exchange for a free PDF copy of the book.

From Blogger to Author?

I?ve considered several books over the years. Some for this blog, some for my poor, sadly neglected foodie blog What We Chow?and now, as my alter-ego pursues collaborative writing on?Dirty Girl?s Kitchen?(be warned, it?s truly for the?unapologetic?profane gal or guy) I seek another book opportunity. But, as kick-butt as self-publishing is, writing a blog is one thing, writing a book is another.

I?ve said many times that having a blog is a brutal task-master. A blog is a living, breathing entity, with a living, breathing audience. Writing a book is no-less a task master, just a different one from marketing to?distribution? And. Let?s face it. Reader expectations are different too. As a blogger, my audience will forgive the occasional typo, not so in a book. See, blogs are generally free but people purchase books and whether the price point is .99 or 4.99, the reader will expect an error-free manuscript. Guy Kawasaki says that after having 75 people review the manuscript of APE, multiple readings by the authors themselves, the copyeditor found 1,500 errors, this was after Guy?s?community?had already provided feedback and content suggestions. Talk about humbling.

What does it cover?

APE covers everything from?crowd-sourcing?editing to determining what your book?s price point should be. The book is chock full of resources for the writer, whether she?s written a blog or not. And for those of us who rarely do anything in print anymore, you?ll love the fact that all the links and resources are clickable links within the book as well as on the?website. There are suggestions that are still considerably important even when e-publishing. Then there are moments where Kawasaki literally says ?tradition be damned? and provides insight into why breaking the rules when e-publishing is important. Kawasaki brilliantly meshes the traditions of book publishing with the practicalities of e-publishing.

I appreciate that the book moves through the steps of self publishing in a logical way, but I still recommend reading it in its entirety before ever typing a single word. After reading the book, I can how some knowledge upfront will save hours later on. And given that writing a book is almost always an act of love (rather than money) saving time and being?efficient?are important.

The Social Role in Self Publishing

Many writers might think the only role for social media is in the marketing and promotional phase. But throughout the book, Kawasaki provides examples of how his social community made the book better, during each phase.

From crowdsourcing feedback to yes, marketing, the Kawasaki discusses how to leverage an active social community. Kawasaki also covers ways to mobilize communities such as KickStarter and IndieGoGo. While Kawasaki didn?t use these methods ?himself, he provides some examples of those who did. ?The authors of APE also continually underscore the need for feedback, which is very consistent with blogging. In the marketing world, we essentially do this through focus groups. But few writers have access to actual focus groups.

Practical Advice

Kawasaki provides several different ways to incorporate community feedback while writing your book. His approach to feedback from readers is very consistent with social media ethos, he invites it and acts on it. Perhaps this is one reason why his books have been so?successful. Or maybe its because he already had a large social media audience before he ever wrote a single book. I do wish Kawasaki would acknowledge this fact ? the time to build community is well before you need them. This goes for businesses and writers.

I?ve found myself referring, highlighting and returning to the book frequently. All in all, if you?ve ever thought that writing a book was in your future, I?d say 2013 is the time to grab that bull by the horn, and start with reading APE. I think you?ll find it well worth your time and chock full of?practical, easy to read advice. ?I?m sure there is no perfect path to self publishing, but I know this will be a resource that I enjoy having in my treasure chest.

For years, Microsoft Office was widely considered to be the way for businesses to get "serious" work done. Google Apps, the cloud-based office suite, wasn't generally thought of as being stable or full-featured enough for company use. But as Google Apps has matured, more and more companies have noticed -- and in 2012 Microsoft found its core business base eroding as offices jumped ship to Google.

Google has been promoting its software for business use since 2006, focusing mainly on small businesses that didn't need all the features of Microsoft Office. Now, The New York Times' Quentin Hardy reports, big companies are starting to notice Google as well. New Google Apps clients in 2012 included Hoffman-La Roche, a Swiss drug company with over 80,000 workers, and the U.S. Interior Department, where 90,000 employees use Google Apps.

Google's pricing is a big mark in its favor with businesses. The Google Apps suite, which includes word-processing, data-entry, spreadsheet, and presentation programs, has added features at a steady pace for several years, but the price of the software -- $50 a year for each business user -- has stayed the same. By contrast, Microsoft Office will cost $400 a year for each business user in 2013, although the Times notes that many companies pay half that with bulk discounts.

Microsoft hasn't ignored the cloud-software trend, though. Last year it released Office 365, an online version of its venerable software suite, which costs between $72 and $240 per year for each user, depending on how many features are needed. Julia White, a manager in Microsoft's business division, says Office 365 is "on track to be [Microsoft's] fastest-growing business," according to the Times, although the company hasn't released figures on usage. In late 2011 and early 2012 Microsoft's business divison made almost $24 billion -- but that revenue came almost entirely from conventional Office software that runs on computers located on companies' premises.

Google announced this summer that more than five million businesses were using its Apps suite, although nearly all of those companies have ten or fewer employees. So big companies like Hoffman-La Roche aren't jumping to Google Apps en masse, although the Times notes that Google won 23 of the 42 large government contracts for which it competed with Microsoft in 2012, compared with 10 for Microsoft.

Neither company is boasting about its total number of enterprise users, and it would be inaccurate to suggest that Microsoft is hemorrhaging business customers. But as companies put more stock in online collaboration, Microsoft will have to find ways to make Office 365 more attractive -- or come up with another strategy to tempt businesses away from Google.

Cave dwelling nettle discovered in China

Dec. 28, 2012 ? South West China, Myanmar and Northern Vietnam contain one of the oldest exposed outcrops of limestone in the world. Within this area are thousands of caves and gorges. It is only recently that botanists have sought to explore the caves for plants. This exploration is yielding many new species new to science, that are known only from these habitats.

The current study was published in the open access journal PhytoKeys.

Kew botanist and nettle expert Alex Monro says, "When my Chinese colleague Wei Yi-Gang from the Guangxi Institute of Botany first mentioned cave-dwelling plants to me, I thought that he was mis-translating a Chinese word into English. When we stepped into our first cave, Yangzi cave, I was spell-bound. It had an eerie moonscape look to it and all I could see were clumps of plants in the nettle family growing in very dark condition."

The plants do not grow in complete darkness but do grow in extremely low light levels, deep within the entrance caverns of the caves (sometimes, in as little as 0.04% full sunlight). The British and Chinese authors have been collecting plants from the Nettle family in this limestone landscape for several years and have just published a paper describing three new species, one from a cave and another two from deep gorges.

The cave-dwelling nettle species in question, was found growing in two caves in the Guangxi province of China. Of the species discovered in gorges, one is known from an unusual and striking rock mineral formation called petaloid travertine. Petaloid travertine is a form of limestone deposited by mineral springs that over time forms large petals of rock, in this case clinging to the vertical walls of a gorge.

These plants are members of a genus of Nettles known as Pilea, that is believed to have over 700 species Worldwide, up to one third of which may remain undescribed.

Pudding Monsters tops iPhone Games of the Week

Now that the holiday season is behind us, we get to sit in that awkward bit of time at the end of the year. That time that is so utterly devoted to reminiscence and top games of the year lists. As such, it?s hard to find out about notable new releases, and most developers avoid this time like the plague. Thankfully, last week was so utterly packed with releases that there?s enough for a second list. I mean, there was a new game from ZeptoLabs, creators of Cut the Rope, and that wasn?t even on last week?s list. So here we go with the last, but certainly not least, new iOS games of 2012.

After the massive success that was Cut the Rope, developer ZeptoLabs has gone against all conventions and branched out in a brand new direction with a new IP. Everyone was probably expecting a Cut the Rope 2, but instead, we get a brilliant puzzle that has you sliding pudding blobs together into bigger pudding blobs. It?s not as quite casual as Cut the Rope, with a slightly higher difficulty that should appeal to a slightly more mature gamer, but it is still charming and adorable with puzzles worth every penny. Definitely don?t miss out on this one.

Only in the open and accessible world of iOS development have we seen projects like this. An ancient eighties fighting game revitalized and re-released as a gesture and timing-based adventure from the creator of the original (who also created Prince of Persia). There are plenty of old references mixed in with the new look and feel of the game, appealing to both modern and old school gamers. There is an elegant simplicity in the violence at play here, and while I don?t foresee it being crazy popular, there is a modern classic to be found in this one.

DoubleFine Productions, with their buckets and buckets of Kickstarter money, are still doing what they do best. They make smaller titles that offer a lot of creativity and charm. The creators of Brutal Legend have no branched into the iOS realm with this wonderfully funny freemium simulation. Only DoubleFine would think of such a hilarious concept as superhero middle management. Yes, it is a freemium game with freemium elements, but DoubleFine has done their best to lessen the brutality of them, and in the end this is a very familiar game with a sense of humor.

3D Realms, creators of Duke Nukem, have been having a pretty good time releasing their old games on mobile devices. Their latest release is that of the controversial 1997 shooter, Shadow Warrior, based on the same engine as Duke Nukem 3D. The controls for Duke Nukem 3D?s port weren?t very cooperative, but it seems like they?ve been vastly improved for the bloodbath that awaits you here. It?s retro ultra-violence at its best. The game is only decent overall, but it?s still worth playing if you miss the simpler shooters of old.

It is a rare day that I promote a match-three game on this weekly list. I?ve never seen a genre get so popular so quickly before dying off just as quickly as I saw with match-threes. Luckily, the developers of Pixel Defenders Puzzle know just how to scratch my gaming itch. Essentially, this is more like a Triple Town, but it isn?t a blatant clone, and simply builds on those solid mechanics. For another thing, it involves a retro RPG pixilated world, with magic, wizards, undead, and the rest. I?m pretty much guaranteed to pay attention when I see such an aesthetic. As it so happens, the game itself is really well done, and worth playing!

The lure of a vacation home is strong this time of year, especially if you live in a chilly latitude. Imagine having a place at the beach. Swimming, tennis and golf in January! T-shirts instead of overcoats!

But can you make it work financially?

Face the facts: It would be awfully tough to turn a vacation home into a money-maker, even if it's somewhere highly sought by vacation renters. A vacation home is a luxury.

But renting it out when you're not using it can bring in substantial income, cutting your ownership costs dramatically. There are tricky tax questions here, which we'll save for another time. For now, let's look at ways to maximize the income.

The first step, of course, comes before buying, when you research the property to find out how much rent it has drawn and how consistently. It will also pay to look at similar properties, to see what they charge, what they offer and find ways to gain an edge.

If the competitors offer 50-inch TVs, maybe you should provide a 55-inch TV -- and add a TV to each bedroom. If competitors offer basic cable service, maybe you should have some premium channels.

Today, many people are never quite free of the office. So think about providing high-speed Internet and Wi-Fi, plus a decent printer/copier/fax/scanner.

Next question: How will you get your renters?

The best option is to combine your own efforts with those of a professional. In many vacation areas, real estate agencies offer rental services, often for a commission of up to 25% of the rent. A good pro will have tips on making your place more appealing and will know how much rent you can get during the high season and offseason.

In a well-designed arrangement, the agent's incentives are aligned with the owner's. Both of you, for instance, want to get the highest rent possible without scaring off prospective renters by overcharging. A good pro will know when it will pay to accept less rather than risk going vacant for a week.

Although the commission is negotiable, keep in mind that the agent will represent other properties and, given a choice, will steer prospective renters to the units that provide the biggest income and rent with the least effort. You might give the agent extra incentive by negotiating a sliding commission that would pay more if your rental income exceeds a given threshold. You might, for instance, pay 20% on the first $10,000 in income, 30% on anything above that.

Be sure that the agent will advertise the property on the multiple listing service for rentals used by all agents in the area, and that other agents will be provided a healthy slice of the commission if they bring in renters. Again, you might try to beat the average.

Also be clear on the duties your agent will perform. Those should include vetting prospective renters, arranging for cleaning and inspection after a renter leaves and sending in a handyman for such things as a plugged drain.

Your deal with the agent should also allow you to seek renters on your own. That will save you on commission costs and spur your agent to beat you to the punch in signing up renters. Many owners advertise on sites such as Vacation Rentals by Owner.

Because prospective renters going to your VRBO site will see your competitors' properties, it would be worthwhile to set up a website of your own on Facebook or a similar service. You can use that when people respond to your flier on the office bulletin board, for instance.

The key is to hustle. If you get a kick out of running a little enterprise, negotiating and keeping track of details, renting out a vacation home can slash your ownership costs.

If the thought of all those chores makes you shudder, maybe owning a second home is not for you.

CHAPEL HILL - Long-standing research efforts have been focused on understanding how stem cells, cells capable of transforming into any type of cell in the body, are capable of being programmed down a defined path to contribute to the development of a specific organ like a heart, lung, or kidney. Research from the University of North Carolina at Chapel Hill School of Medicine has shed new light on how epigenetic signals may function together to determine the ultimate fate of a stem cell.

The study, published December 27, 2012 by the journal Molecular Cell, implicates a unique class of proteins called polycomb-like proteins, or PCL's, as bridging molecules between the "on" and "off" state of a gene. While all of these specialized types of cells share the same genetic information encoded in our DNA, it is becoming increasingly clear that information outside the genome, referred to as epigenetics, plays a central role in orchestrating the reprogramming of a stem cell down a defined path.

Although it is understood that epigenetics is responsible for turning genes "on" and "off" at defined times during cellular development, the precise mechanisms controlling this delicate process are less well understood.

"This finding has important implications for both stem cell biology and cancer development, as the same regulatory circuits controlled by PCL's in stem cells are often misregulated in tumors," said Dr. Greg Wang, senior author of the study and Assistant Professor of Biochemistry and Biophysics in the UNC School of Medicine and a member of UNC Lineberger Comprehensive Cancer Center.

The study, led by postdoctoral research fellows Drs. Ling Cai and Rui Lu in the Wang lab, and Dr. Scott Rothbart, a Lineberger postdoctoral fellow in the lab of Dr. Brian Strahl, Associate Professor of Biochemistry and Biophysics in the UNC School of Medicine and a member of UNC Lineberger Comprehensive Cancer Center, identified that PCL's interact with an epigenetic signal associated with genes that are turned on to recruit a group of proteins called the PRC2 complex which then turn genes off.

CHAPEL HILL - Long-standing research efforts have been focused on understanding how stem cells, cells capable of transforming into any type of cell in the body, are capable of being programmed down a defined path to contribute to the development of a specific organ like a heart, lung, or kidney. Research from the University of North Carolina at Chapel Hill School of Medicine has shed new light on how epigenetic signals may function together to determine the ultimate fate of a stem cell.

The study, published December 27, 2012 by the journal Molecular Cell, implicates a unique class of proteins called polycomb-like proteins, or PCL's, as bridging molecules between the "on" and "off" state of a gene. While all of these specialized types of cells share the same genetic information encoded in our DNA, it is becoming increasingly clear that information outside the genome, referred to as epigenetics, plays a central role in orchestrating the reprogramming of a stem cell down a defined path.

Although it is understood that epigenetics is responsible for turning genes "on" and "off" at defined times during cellular development, the precise mechanisms controlling this delicate process are less well understood.

"This finding has important implications for both stem cell biology and cancer development, as the same regulatory circuits controlled by PCL's in stem cells are often misregulated in tumors," said Dr. Greg Wang, senior author of the study and Assistant Professor of Biochemistry and Biophysics in the UNC School of Medicine and a member of UNC Lineberger Comprehensive Cancer Center.

The study, led by postdoctoral research fellows Drs. Ling Cai and Rui Lu in the Wang lab, and Dr. Scott Rothbart, a Lineberger postdoctoral fellow in the lab of Dr. Brian Strahl, Associate Professor of Biochemistry and Biophysics in the UNC School of Medicine and a member of UNC Lineberger Comprehensive Cancer Center, identified that PCL's interact with an epigenetic signal associated with genes that are turned on to recruit a group of proteins called the PRC2 complex which then turn genes off.

How Do I Tell My Friend Her Place Smells Like Cat Pee? | xoJane

I recently visited the apartment of a friend for the first time and got a narsty whiff of excessive cat pee. I was only there for about 5 minutes to drop something off, and I don?t know her all that well, so I don?t even know if she has cats. It?s one thing to break it to a close friend that her apartment reeks. It?s another thing entirely to unload your opinions on an acquaintance/stranger whose emotional intelligence has yet to be revealed to you. I?m kind of a pussy when it comes to this sort of thing, so I?d rather not say anything at all and pray that I never have to go over there again. But is that really the best way to handle this situation?

My former cat, Joga (named after Bj?rk?s song, which matches her personality dead-on), now belongs to my parents in a feline-owner switcheroo stealthily pulled off by my mom. She once read in some crazy Russian newspaper that cats are very handy in lowering high blood pressure, and asked if she could ?borrow? Joga for a couple of weeks to test out her new ?scientific? discovery. I lovingly obliged, sending the cat off to Pennsylvania, and yada yada yada, she still lives there like a fat furry princess two years later.

But when Joga still lived with me in my pathetically cramped apartment, I?m proud to say my living quarters were never cat-pee-scented. None of my friends ever told me either way or anything, so maybe I?m just as na?ve as the current cat pee offender. My lovely circle of friends can be brutally honest sometimes though (Recent comments I've received: ?Your hair is super fried, but you could sorta pull it off if you were dressed like a surfer chick,? ?I hate your outfit, nothing matches,? and ?I have never seen you NOT dress slutty.?), so I?m going to assume they would have told it to me straight.

Since we?re on the topic of pet odor, let?s say you have a cat and you want to get to the root of the problem. How does one keep the pet stank out of the house, anyway?

I consulted my friend, a crazy cat lady who has not one but TWO cats (a ballsy move for New York City, imho) for advice. In all the years I?ve known her, her apartments have always smelled so fresh and so clean you?d never even know she had cats (of course, you?d know if you were Facebook friends with her, bitch posts photos of her cats and other random cats like it?s her JOB). Here is what she told me:

1. Clean the litter box every day. If you?re lazy, do it AT LEAST every other day.
2. Use Arm and Hammer brand cat litter, it?s awesome.
3. Mix in an odor-neutralizing powder in the litter (Arm & Hammer makes this stuff, too).
4. Place an odor absorber near the litter thingy.

5. Dump the entire box of litter and wipe down the litter box and any affected area as often as possible. Once a month MINIMUM.
6. You are what you eat. Feed your cats high quality food for nicer-smelling droppings.

7. Invest in litter box ?furniture.? It can be pricey, but so worth the feeling of someone coming in and asking, ?Where on earth is your litter box??

For the price, I?d expect a rhinestone-encrusted model to match my iPhone, but it?s much classier than looking at a cat toilet that doesn?t flush.

This is pretty basic advice if you ask me (except for #5, which I never did. It?s really gross and I hate it, but you should do it), but for some reason some people just don?t get it, or maybe their sense of smell isn?t that great and they think it?s all good or something.

Now, some cats are gonna be dicks and disrespect your authority by refusing to cover up their daily deeds in the litter box, or they?ll leave little presents lying around for you in your household. If you are one of these people, these rules don?t apply. All I can say is I?m sorry and don?t piss off your cat, whatever you do. Good luck.

If you?re paranoid about your place smelling off, sans or avec pets, just use common sense and bomb it with air fresheners. Just do me a favor and use fancy stuff (Yankee candles = NO) so it looks like you know how to accessorize rather than trying to hide something.

Anyway, back to my friend with the cat pee issue she is seemingly unaware of. I have thought long and hard about this and I still don?t have a solution. I could get all passive-aggressive-like on her and share this article on Facebook, hoping she sees it and magically realizes it?s about her. Do you have a better suggestion?

Installation proper is therefore not lengthy, requesting the user to select full or custom setup; pick the opt-in Malware-Feedback that implies agreeing to participate in the G Data Malware Information Initiative; and decide whether automatic signature updates are to be performed hourly. Everything else is pretty usual, including the choice between 30-day trial and commercial version, so no particular skills are required to complete the procedure.

The first impression from the user interface was kind of dubious. On the one hand, it looks a little over-simplistic and old-fashioned ? at least compared with some of the competitor products we tested recently. This might be explained by the fact the 2013 versions of the latter were made to fit into the Windows 8 style. Since G Data AntiVirus 2013 does not fully support all new features of this OS version for the time being (e.g. the new Windows 8 interface), that might be the thing affecting its external manifestation.

On the other hand, the interface is tailored to have everything it takes to manage the program?s functionality and be duly informed about protection status and security related events ? apparently, simplicity is not always a bad thing. The left-hand pane includes licensing information and one really helpful component called ?CPU load? which displays memory usage by G Data and System in separate icons. Security status displayed on the GUI?s home section is another useful feature; moreover, the related issues can be fixed in a single click ? that?s what the ?Correct? button is there for. Program settings and auxiliary options (accessing help, logs and product information, creating rescue CD) are the only two buttons on the top. The main features are concentrated below: those are virus protection, virus signatures, web protection and email check. Digging deeper into the settings didn?t turn out to be a more puzzling experience than exploring the main interface: you mostly get options to select or de-select ? as easy as that.

Now, let?s assign G Data AntiVirus 2013 some tasks and see what it?s like in action. First thing we did was trigger signature update. This process implies updating two engines (A and B), as well as the Whitelist. As long as the Internet connection is active, it goes okay, with no lags or other issues whatsoever.

Next, we ran system scan which sticks to the following sequence: system areas, memory and startup, rootkit check, and virus check proper. The process went generally fine until it reached the ?Virus check? part: it turned out way lengthier than we could have possibly anticipated, with only 30% progress reached in 45 minutes. At this point, it?s fair to remark that we kept the default performance parameters unaltered, while there is an option of customizing security / performance correlation ? in the latter case, if the optimal balance is configured the scan times get reasonable. With all the unquestionable strong points, G Data AntiVirus 2013 might obviously do a better job in terms of the scan times. Furthermore, in our humble opinion, GUI upgrade for full Windows 8 compatibility would do the vendor a favor by attracting a broader user base.

Features

In addition to smart virus protection based on the use of two engines, G Data AntiVirus 2013 accommodates some Internet security features to keep you safe when visiting sites, exchanging emails, and banking online. This added value is flattering because it means you get more than just an antivirus. Now, some details.

  • AntiVirus Monitor is the core protection feature integrated in this product. Composed of two mutually-enhancing engines, this component serves as a powerful tool for filtering out viruses, rootkits, Trojans, adware, dialers, worms, and other types of malware. Owing to behavior monitoring capability, G Data is constantly on the lookout for suspicious applications running on your machine or attempting to access it. The innovative mix of signature detection and behavior watch makes this software highly sensitive to zero-days, i.e. new threats.
  • Security / Performance optimization is about the choices you are entitled to do in terms of tuning your preferred level of protection and system productivity. Furthermore, the utility prevents phishing attacks and monitors instant messenger activity.
  • Employing cutting-edge Mail Cloud techniques, G Data virtually nullifies contamination probability via the email channel which is frequently used by scammers these days. The kernel component of this feature is called the OutbreakShield whose objective is to ensure instant protection against email malware outbreaks.

Furthermore, according to a number of recent tests conducted by the worldwide-known AV-Comparatives, G Data showed 99.9% detection rate, which is the best result out of the set of 15 evaluated products, and hence got Advanced award ? could have been Advanced+ if it weren?t for false alarms that were spotted. In AV-Comparatives? latest Real World Protection Test, the software being reviewed turns out to be one of the 3 best products out of the 21 utilities tested.

The above facts leave no room for doubt with regard to detection accuracy and cleaning capability hard-coded into G Data AntiVirus 2013. Nokia, RIM settle old disputes in new patent pact

(AP) ? Nokia Corp. and Canadian smartphone rival Research In Motion have agreed on a new patent licensing pact which will end all existing litigation between the two struggling companies, the Finnish firm said Friday.

The agreement includes a "one-time payment and on-going payments, all from RIM to Nokia," Nokia said, but did not disclose "confidential" terms.

Last month, Nokia sued the Blackberry maker for breach of contract in Britain, the United States and Canada over cellular patents they agreed in 2003. RIM claimed the license ? which covered patents on "standards-essential" technologies for mobile devices? should also have covered patents for non-essential parts, but the Arbitration Institute of Stockholm Chamber of Commerce ruled against RIM's claims.

Major manufacturers of phones and wireless equipment are increasingly turning to patent litigation as they jockey for an edge to expand their share of the rapidly growing smartphone market.

Nokia is among leading patent holders in the wireless industry. It has already received a $565 million royalty payment from Apple Inc. to settle long-standing patent disputes and filed claims in the United States and Germany alleging that products from HTC Corp. and Viewsonic Corp. infringe a number of its patents.

The company says it has invested ?45 billion ($60 billion) during the last 20 years in research and development and has one of the wireless industry's largest IPR portfolios claiming some 10,000 patent families.

Nokia stock was down more than 2 percent at ?3.09 in early afternoon trading in a depressed market in Helsinki.

In the following excerpt from the Gold and Precious Metals Report, an experienced portfolio manager discusses his investment methodology:

TWST: In general, how would you describe your investment strategy as it pertains to the OCM Gold Fund?

Mr. Orrell: Our first approach always comes from the macro standpoint of where we believe gold is going - what's gold doing? And then, we go from there to the individual issues. So looking at mostly in the mining stocks, we are predominantly in the gold miners, and we have what we call a tiered approach of having positions in major producers and immediate junior producers, and the exploration and development companies. And then, that percentage allocation in each group changes depending on our view of where we believe the value is. Further, we do believe that capital flows do run down to each segment, depending on where you are in various cycles in the gold market at that moment. So we like to have companies that are exhibiting strong fundamentals, from cash flow generation to reserve replacement to reserves per share, and we also are looking for companies that can create value through the drill bit.

TWST: Would you elaborate a little bit about the characteristics you're looking for in a gold mining company? And conversely, what would make a gold mining company an unattractive investment in your mind?

Mr. Orrell: What we're looking for are companies that are showing discipline. On the larger side, we're looking for companies that are showing a discipline in terms of their capital deployment, and that they're holding equity dear. That has certainly been an issue. Mining companies that have become serial issuers of equity; that's not what we're looking for. We know that it is a capital-intensive business, but there has to be a measured approach. So the companies that we focus on in our portfolio are companies that have exhibited an ability to manage their business in terms of doing what they say they are going to do - replacing reserves while also looking to grow their production portfolio with higher-quality assets. Basically, that's what we're looking for.

Conversely, companies that we're shying away from are companies that have exhibited a poor track record of execution - from reserve replacement to capital deployment. We avoid companies that are not investor friendly from the standpoint of realizing that shareholders need to see a return on equity through dividends. Companies that do put the shareholder high on that priority list, and that there is going to be a call on a portion of the cash flow from each operation because the mining business is a depleting resource business and the shareholders need to participate in each operation - we want companies where the management sees that. Otherwise, it's a fool's game for the investor where the only winners are engineers, geologists, suppliers and the tax man.

TWST: Would you give us three examples of gold mining companies currently in the fund and tell us what you like about each of them?
